EU AI Act Article 50 guides: live duties, one remaining deadline

Current to 26 August 2026 · updates land in the changelog.

Article 50 of the EU AI Act has applied since 2 August 2026. Chatbots and AI agents must disclose themselves, generated content must carry machine-readable marks, deepfakes and public-interest AI text must be labeled, and people exposed to emotion recognition must be told — with exactly one transition still running: the 2 December 2026 marking grace for systems placed on the market before August. These guides map the whole regime from the regulation and the Commission's final guidelines.

Quick answers

When did EU AI transparency rules start applying?
2 August 2026 — Article 50's duties are live, with one transition: machine-readable marking for generative systems placed on the market before that date applies from 2 December 2026.
Who do the Article 50 duties fall on?
Providers carry interaction disclosure (50(1)) and content marking (50(2)); deployers carry emotion-recognition information (50(3)) and deepfake/text disclosure (50(4)). App makers are frequently both.
What are the penalties?
Up to €15,000,000 or 3% of worldwide annual turnover, whichever is higher — for SMEs and startups, whichever is lower (Articles 99(4) and 99(6)).
Ship the disclosures before enforcement finds the gap.
